Terms of Service

These Terms of Service ("Terms") govern your access to and use of Simplo's software and websites (the "Service"). By creating an account or using the Service, you agree to these Terms. If you are using Simplo on behalf of a business, you represent that you have authority to bind that business.

1. The Service

Simplo provides online booking, digital e-signature waivers, and customer-marketing tools for activity venues and appointment-based businesses. We may update or improve features over time.

2. Accounts

You're responsible for your account, your login credentials, and all activity under your account. Provide accurate information and keep it current.

3. Subscriptions & billing

Paid plans are billed on a recurring monthly basis. Fees are stated on our pricing page. You can cancel anytime; cancellation stops future renewals. Simplo charges a flat subscription and does not take a percentage of your bookings.

4. Payments (bring-your-own-processor)

Customer payments are processed by the payment provider you connect (Stripe, Square, or Shopify). Those funds flow directly to your account, and your relationship with that processor is governed by their terms. Simplo is not a party to, and not liable for, those payment transactions.

5. Customer data & waivers

You are responsible for the lawfulness of the data you collect and the waiver language you publish, and for obtaining any required consents from your customers. Simplo stores waiver records with an audit trail to support their enforceability, but Simplo does not provide legal advice and does not guarantee any particular legal outcome. You retain ownership of your customer and waiver data.

Simplo and its software, branding, and content are owned by Simplo. We grant you a limited, non-exclusive, non-transferable right to use the Service per these Terms.

8. Disclaimers

The Service is provided "as is" without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free, or that waiver records will be enforceable in every jurisdiction.

9. Limitation of liability

To the maximum extent permitted by law, Simplo will not be liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms. On termination you may export your data for a reasonable period.

11. Changes

We may modify these Terms; material changes will be reflected by the "last updated" date. Continued use after changes means you accept the updated Terms.
